A-Check America is committed to protecting your personal information.  Therefore, in regard to receiving personal data from the European Union and EEA members, we are committed to adhering to the Safe Harbor privacy principles and the 15 FAQs which make up the U.S.-EU Safe Harbor Framework which is administered by the U.S. Department of Commerce. This policy has been developed to spell out the manner in which A-Check America Protects individually identifiable information in compliance with International Safe Harbor Privacy Principles.

Notice

A-Check America notifies individuals from whom individually identifiable information is collected about how the information will be used. Individually identifiable information collected by A-Check is used within the narrow confines of employment-related screening.

Choice

Information collected by A-Check America is collected and forwarded to our client who requested the inquiry only after the unambiguous written consent of the individual subject to the inquiry is obtained. The subject may rescind their consent at any time through a written communication to the address or fax number below.

Onward Transfer

As part of our contractual agreements, A-Check America Clients have agreed in writing to follow adequate data protection principles and may not forward personally identifiable information to unauthorized parties.

Security

A-Check America makes every effort to prevent unauthorized access or loss of collected information. Hard copies of collected information are properly stored in card access-controlled facilities protected by video security and alarm systems. Digitally stored information resides in a secure environment and is transmitted using Secure Socket Layer (SSL) encryption. Stored data is backed up to an SAS 70 certified co-location to prevent disaster-caused data losses. Employees and clients sign binding non-disclosure agreements prior to engaging with A-Check America.

Data Integrity

Data collected by A-Check America is collected for the purpose of employment screening. Our sources of information are those deemed most accurate by a consensus of the established  background screening industry and through our 30 years of experience. The information we collect must be relevant to the purposes of determining an applicant's suitability for employment. A-Check America has an  effective and swift dispute resolution procedure in place to allow individuals a chance to correct or delete inaccurate information. Individuals may contact us through the methods outlined at the beginning of this document to dispute any such information.

Enforcement

A-Check America's Director of Operations is responsible for enforcing these rules and ensuring Safe Harbor principles are adhered to.

Self Assessment

At periodic intervals, A-Check America's president, Director of Operations and management team will perform a self-assessment to ensure compliance with the International Safe Harbor Privacy Principles.

Employee Training and Dispute Mechanism

A-Check America employees undergo initial training of at least two weeks, during which the importance and particulars pertaining to Privacy Principles as outlined by the FCRA and the International Safe Harbor Privacy Principles are taught. A-Check America's dispute mechanism is activated by a phone call, fax or written communication. A-Check America's policy is to reply to inquiries within the hour and resolve disputes within 3 business days.
